Legality by State
- Explicitly permit the sale of kratom regardless of the level of 7- hydroxymitragynine. However, sales are subject to other limitations, including labeling, packaging, and/or age restrictions.
- Explicitly permit sale of kratom that contains a level of 7-hydroxymitragynine in the alkaloid fraction that is two percent (2%) or less of the overall alkaloid composition of the product. Kratom with a level above this limit is prohibited. Further, sales of kratom are subject to additional limitations, including labeling, packaging, and/or age restrictions.
- Neither permit nor prohibit the sale of kratom or kratom products. It is possible that kratom could still be illegal under these jurisdictions’ controlled substances laws, which—like the CSA—generally treat hallucinogenic substances and stimulants as Schedule I drugs.
- Explicitly list kratom as a Schedule I drug or controlled substance and, therefore, prohibit the sale of kratom.
